Lawyers are challenging the jurisdiction of judges that are over age 75, according to a report from the Toronto Star. Deputy judges, usually retired Federal Court judges, are paid on a per diem basis to hear immigration and intellectual property cases, among others. Justice Tannenbaum’s cases have already been rescheduled to be heard by others. The affected judges include:

- The Honourable Max M. Teitelbaum, age 77
- The Honourable Maurice E. Lagacé, age 77
- The Honourable Orville Frenette, age 82
- The Honourable Louis S. Tannenbaum, age 77
- The Honourable W. Andrew MacKay
